Overview

OLM Law’s Dispute Resolution & ADR practice acts for corporates, financial institutions, government bodies and high-net-worth individuals in contentious matters across the Kenyan courts and in domestic and international arbitration. We have appeared before the High Court of Kenya (Commercial Division), the Court of Appeal and various specialised tribunals, and regularly conduct matters under the rules of the Nairobi Centre for International Arbitration (NCIA), the ICC and the LCIA.

Our work covers commercial litigation, contract disputes, shareholder and partnership disputes, employment claims, land disputes, debt recovery, insolvency proceedings and regulatory enforcement matters. We bring the same disciplined, outcome-focused approach to every contentious mandate — from pre-litigation strategy through to enforcement of awards and judgments.

Our Approach

We believe that the best dispute resolution strategy begins before proceedings are issued. Our team works with clients to assess the strength of their position, the likely timeline and cost of litigation, and the availability of alternative pathways — negotiated settlement, mediation or arbitration — that may achieve a better commercial result more efficiently.

Where litigation is unavoidable, we are tenacious advocates. We are known for our thorough preparation, our command of the factual and legal issues, and our ability to distil complex disputes into clear, persuasive arguments. We do not over-litigate: we identify the pivotal issues and concentrate resources where they matter most.

For clients with cross-border disputes or enforcement requirements, we coordinate with counsel in other East African jurisdictions and maintain strong relationships with international arbitration practitioners, ensuring seamless advice regardless of where proceedings are seated.
