Trademarks are increasingly gaining significance in Kenya. In this note, we briefly look at what constitutes trademarks and how they can be protected.

On 17 February 2023, the High Court at Nairobi allowed Civil Appeal No. E127 of 2020: Commissioner of Domestic Taxes versus Bank of Africa Limited upholding the finding of the Tax Appeals Tribunal that VAT is not payable on interchange fees received by issuing banks (i.e., banks issuing credit and debit cards). 

Since early 2020, a unique type of maritime fraud has entrenched itself at the Port of Mombasa, Kenya. 

With some slight variations, the maritime fraudulent scheme plays out as follows:

  1. A fraudster identifies a manufacturing or retail company (hereafter, “the Shipper”) with an international presence
